In a significant legal decision, the International Crimes Division of the High Court has upheld the seizure of property belonging to King Charles Wesley Mumbere of the Rwenzururu Kingdom. The ruling, delivered by Justice Alice Komuhangi Khaukha, comes in response to King Mumbere’s plea to release his seized property, which includes his residential palace, vehicles, and personal firearm.
The court’s decision was based on the fact that the seized items are considered exhibits in the ongoing trial of Thembo Kitsumbire, the King’s former Prime Minister. Justice Komuhangi emphasized that releasing the property at this stage could potentially prejudice the case, especially if charges are confirmed against Kitsumbire, who still faces trial related to the 2016 events.
While King Mumbere’s legal team argued that the charges against him were dropped in June 2023, the court pointed out that Kitsumbire’s trial remains unresolved. Therefore, according to specific court rules, exhibits cannot be released or destroyed until all avenues for appeal are exhausted.
The background of the case reveals that King Mumbere and his former Prime Minister were arrested in November 2016 following clashes between the Rwenzururu Kingdom and security agencies, resulting in fatalities. Although charges against King Mumbere were withdrawn in 2023, Kitsumbire continues to face trial for offenses including treason and terrorism.
This ruling underscores the complexities of the legal proceedings surrounding the 2016 events and highlights the importance of adhering to established legal procedures. Until Kitsumbire’s trial concludes and all legal avenues are exhausted, King Mumbere’s seized property will remain under the custody of the court
